Can bill collectors call your work place?

I have one calling me about a student loan at my work. The IRS has already been taking my refunds and applying them towards the loan, so I don't get it!

Can bill collectors call your work place?

From the Fair Debt Collection Practices Act:

How may a debt collector contact you?

A collector may contact you in person, by mail, telephone, telegram, or fax. However, a debt collector may not contact you at inconvenient times or places, such as before 8 a.m. or after 9 p.m., unless you agree. A debt collector also may not contact you at work if the collector knows that your employer disapproves of such contacts.

Can you stop a debt collector from contacting you?

You can stop a debt collector from contacting you by writing a letter to the collector telling them to stop. Once the collector receives your letter, they may not contact you again except to say there will be no further contact or to notify you that the debt collector or the creditor intends to take some specific action. Please note, however, that sending such a letter to a collector does not make the debt go away if you actually owe it. You could still be sued by the debt collector or your original creditor.

.........................................

However, if the money is owed to the IRS, I'm surprised they're even calling you at all. We owe some money to them due to 2 old returns that were filed incorrectly. We've been working on paying them for nearly a year and before then until now, they've never called us a single time.

If you owe money on a student loan... pay it! It won't go away, and waiting for a refund check to pay it once a year isn't going to work either. You obviously have a job (where they keep calling you), so live on less than you make and throw everything else left of your paycheck towards this loan.

they are not sopposed to but they do..you need to explain the situation to a manger or have a friend act on your behalf and request that the calls stop the next time one comes in and if they do not charges will be filed...or have a friend tell them you no longer work there...you need to also tell this company that you refuse to discuss anything by phone and they need to mail you correspondance....

COLLECTION AGENCIES CANNOT:

Call or write to you more than three times a week. Only one of those calls can be at your workplace. They cannot call you between 9 p.m. and 8 a.m.

You can stop them by requesting it when they call, if it's not possible any arrangement for payments, tell them to stop calling to your work place, and stop contacting you, in anyway, it's against the law to keep doing even if you have requested it, if they keep doing it, you can report them to the department of business affair, be live me you have rights that cannot be jumped.

Good Luck

Yes unless they are notified in writing, they can try to contact you anywhere they want.

I would suggest that you send them a letter advising that you cannot be called at work and advising that the Student loan program has already attached your tax refund. Let them know how much you have paid to date through this.

What don't you get? You're in default on a student loan, so of course they're going to try to contact you. Garnishing your tax refund is just one of the tools they use to collect the debt. Unless your last tax refund paid the debt in full, they're going to keep trying to collect it. They're not just going to wait until it's paid off with your tax refunds.

You need to send the collection agency a certified return receipt letter telling them never to contact you at work. Then you need to call them and work out a repayment plan. Student Loans are the worst ones to default on. There's no statute of limitations on them.
